1. Service Description

GotGoodNews.co is a novelty celebration and good-news delivery service that delivers user-submitted messages via AI-generated phone calls. You write a celebratory message, choose a delivery style, and our AI calls the recipient to share your good news in an unforgettable way. This service is intended solely for entertainment, celebration, and hype purposes.

2. User Representations & Warranties

By using this service, you represent and warrant that:

• You are at least 18 years of age.
• The recipient is at least 18 years of age.
• You have a personal relationship with the recipient (friend, family member, colleague, etc.).
• Your message is intended as celebration, hype, or entertainment, not to threaten, harass, intimidate, or cause genuine harm.
• The good news you are sharing is truthful and accurate. You will not use this service to deliver fabricated or misleading positive news.
• The phone number you provide belongs to the intended recipient.
• You will not use this service to impersonate any authority figure, including law enforcement, medical professionals, or employers.

3. Prohibited Content

Messages submitted through GotGoodNews.co may not contain:

• Threats of violence or harm
• Discriminatory slurs or hate speech
• False emergency information
• Impersonation of authorities (police, doctors, employers, government officials)
• Fake prizes, contest winnings, or sweepstakes announcements
• Fabricated medical results (e.g., fake pregnancy, fake "all clear" diagnoses)
• False financial news (fake inheritances, fake lottery wins, fake loan approvals)
• Scam-like messages or content designed to deceive the recipient
• Fake legal outcomes (fabricated court results, fake immigration approvals)
• Sexually explicit content
• Any content that violates applicable local, state, or federal law

We reserve the right to refuse, modify, or reject any message at our sole discretion.

Truthfulness requirement: Good news must be genuine. Using this service to deliver false positive information — even as a "joke" — can cause real emotional harm when the truth comes out. We take this seriously and may ban users who repeatedly submit fabricated good news.

4. Consent & Recipient Rights

• Recipients must opt in via SMS before receiving a call. An SMS is sent to the recipient asking them to reply YES to accept or NO to decline the call.
• If a recipient declines, does not respond, or texts STOP, no call will be placed.
• Recipients may block future calls at any time by texting STOP to our number.
• The initial SMS and phone call are automated and use AI-generated voice technology. This is disclosed to the recipient in the SMS and at the beginning of the call.

5. No Refund on Decline

If the recipient declines the call (replies NO, does not respond, or has opted out), no refund will be issued. The service fee covers the attempt to deliver your message, including the cost of the opt-in SMS. By placing an order, you acknowledge and accept this policy.

6. Limitation of Liability

GotGoodNews.co is provided "AS-IS" and "AS-AVAILABLE" for entertainment purposes only. To the fullest extent permitted by law:

• We make no warranties, express or implied, regarding the service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We are not liable for the recipient's emotional reaction, any relationship consequences, or misunderstandings arising from the delivered message.
• Our maximum liability for any claim arising from your use of the service is limited to the amount you paid for the specific transaction giving rise to the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless GotGoodNews.co, its operators, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the service
• The content of your submitted message
• Any claims made by the recipient
• Your violation of these Terms
• Your violation of any applicable law or regulation

8. Content Moderation

We reserve the right to review, modify, or reject any message at our sole discretion, without notice or refund. Messages may be pre-screened by automated systems and/or human reviewers. Pre-screened messages may still be adapted by our AI for natural delivery. We are under no obligation to deliver any message that we determine, in our sole judgment, violates these Terms or poses a risk of harm.

9. Call Recording & Data

• All calls are recorded for quality assurance, compliance, and dispute resolution purposes.
• Call recordings are retained for 90 days and then permanently deleted.
• Recipients are informed that the call is being recorded both in the opt-in SMS and at the beginning of the phone call.
• We may use anonymized, aggregated data for service improvement and analytics.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration (see Section 11) shall be brought in the state or federal courts located in Georgia.

11. Dispute Resolution & Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Georgia.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and NOT in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
