1. Acceptance of Terms

By accessing or using GotGoodNews.co (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Firestart LLC ("we," "us," or "our"), the operator of GotGoodNews.co. We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

GotGoodNews.co is an AI-powered celebration service that allows users ("Senders") to arrange for an automated, AI-generated voice call to be placed to a third party ("Recipient") delivering good news in an unforgettable way. Calls are recorded and may be made available to the Sender after delivery.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older. We do not knowingly provide the Service to minors. You also represent that you have the legal capacity to enter into a binding contract and that your use of the Service does not violate any applicable laws.

You agree NOT to use the Service to:

• Contact anyone you do not personally know or who has not consented to be contacted.
• Harass, threaten, intimidate, stalk, or abuse any individual.
• Impersonate a government agency, law enforcement, financial institution, medical professional, or any other entity in a manner intended to deceive.
• Deliver messages that are defamatory, obscene, fraudulent, or otherwise illegal.
• Contact minors (individuals under 18 years of age).
• Use the Service in connection with any illegal activity or scheme.
• Cause emotional distress by delivering false information intended to be believed as genuine (e.g., fake death notifications, fake medical emergencies).
• Violate any applicable local, state, federal, or international law or regulation.

We reserve the right to refuse, cancel, or reverse any order that we believe, in our sole discretion, violates these Terms or may expose us or others to harm or legal liability.

6. Payment and Refunds

The Service is provided at a per-call fee as displayed at the time of purchase. Payment is processed through our third-party payment processor. By submitting payment, you authorize the charge to your selected payment method.

• Calls are charged only if the Recipient answers.
• If the Recipient does not answer, you will not be charged.
• All sales are final. Refunds are not provided except where required by applicable law or at our sole discretion.

7. Indemnification

You agree to defend, indemnify, and hold harmless Firestart LLC, its members, officers, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any applicable law, including the TCPA or any state recording consent law;
• Any claim by a Recipient that they did not consent to receive a call; or
• Any content or message you submit through the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FIRESTART LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRESTART LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. We collect the Recipient's phone number solely for the purpose of placing the requested call and do not retain it beyond what is necessary to deliver the Service.

11. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

YOU AND FIRESTART LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

This arbitration agreement does not apply to claims that qualify for small claims court in the jurisdiction where you reside.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the courts located in DeKalb County, Georgia.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Firestart LLC with respect to the Service and supersede all prior agreements and understandings.
